By using Telepilot ("the Service"), you accept these Terms.

1. Service description

Telepilot provides tools for managing Telegram channels: scheduling, reposting, analytics, and AI-assisted content. The Service is accessed via the web platform (telepilot.me) and the Telegram Mini App.

2. Account and access

You may create an account via Telegram, Google, or a local username/password. You are responsible for keeping your credentials safe and for activities performed under your account. Minimum age: 16.

3. Plans, payments, and refunds

• Free plan: limited usage as published on the pricing page.
• Paid plans (Pro, Business): billed monthly or yearly via PayPal. Auto-renewal until canceled.
• Refunds: subscription is non-refundable after 7 days; AI credit packs are non-refundable once used.
• Cancellation: you can cancel at any time via PayPal. Plan remains active until the end of the paid period.

4. Acceptable use

You agree not to use Telepilot to:

• Send spam, phishing, or harmful content;
• Distribute illegal content (violates national/EU laws or Telegram TOS);
• Send unsolicited mass DMs to your channel subscribers;
• Repost content from channels you do not have copy rights to or explicit permission from;
• Use AI to impersonate real people or spread disinformation;
• Create multiple accounts to bypass plan limits;
• Bypass rate-limits or attempt to abuse the platform;
• Resell access without prior written agreement.

Violations may result in immediate account suspension without refund. We reserve the right to remove specific content reported as abusive.

5. AI content

AI-generated text is provided "as-is". You are responsible for reviewing and publishing the content. Telepilot does not claim ownership of AI outputs but cannot guarantee accuracy or originality.

6. Referral program

You earn commission on the first paid subscription of users you bring. Commission is paid via PayPal or TON wallet upon request, subject to a cooldown and minimum payout threshold. We reserve the right to reject commissions for fraudulent referrals (self-referral, fake accounts, paid traffic that violates other platforms' TOS).

7. User responsibility for third-party data

If you manage channels containing subscribers' personal data, you are the Data Controller under GDPR. Telepilot acts as an external Processor for technical processing only. You must provide your subscribers with an adequate privacy notice.

8. User-generated content

Telepilot is a platform that allows users to schedule and publish content on Telegram. We do not pre-moderate, endorse, or otherwise adopt as our own the views or claims of content published through the Service. Each user is solely responsible for the content they publish on their Telegram channels via Telepilot, including compliance with copyright laws, national/EU regulations, and Telegram Terms of Service. Telepilot is not liable for damages, disputes, or claims arising from content published by users.

9. Copyright complaints

Telepilot respects intellectual property rights. If you believe content published through the Service infringes your copyright, send a notice to our support including: identification of the copyrighted work, identification of the infringing content (channel and message URL if possible), your contact information, and a good-faith statement. We will review notices within 48 hours and remove infringing content where the notice is valid. Targeted users may submit a counter-notification within 10 days of removal.

10. Limitation of liability

Telepilot is provided without warranty. We are not liable for indirect damages (lost profits, data loss, channel suspensions caused by Telegram, etc.). Maximum total liability is limited to the amount you paid in the last 12 months.

11. Indemnification

You agree to indemnify and hold Telepilot harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in breach of these Terms; (b) content you publish that infringes third-party rights (copyright, trademark, privacy, etc.); (c) your violation of applicable laws or Telegram's Terms of Service. Telepilot reserves the right to assume the exclusive defense of any matter subject to indemnification, at your expense.

12. Telegram API risk

Telepilot operates through Telegram's official API. Telegram may at any time, without prior notice: modify the API, suspend or ban bots and user accounts, apply rate limits, change channel/bot permissions, or terminate features. Telepilot is not liable for service disruptions, data loss, or damages caused by Telegram's decisions, technical limitations, or policy changes. Subscription periods impacted by Telegram-side restrictions are not subject to refund.

13. Service availability

We strive for 99% uptime but make no SLA guarantees. Maintenance windows may temporarily affect availability.

14. Force majeure

Neither party is liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to: natural disasters, pandemics, war, government actions, cyberattacks, failures of third-party providers (Telegram, PayPal, AWS, OpenAI), or major internet outages. Affected obligations are suspended for the duration of the event.

15. Service termination

We reserve the right to terminate the Service with at least 30 days notice. In that case we refund the remaining portion of paid plans. After account deletion you have 30 days to request data export; after this window personal data is permanently removed.

16. Changes to terms

We may update these Terms. Significant changes will be announced via the support bot or platform notice with at least 14 days notice.
